Divorce does not always have to be adversarial. At Kellogg & Palzer, P.C., we strive to reach amicable settlements so that both parties can move forward with their lives. Working towards a fair result is usually the goal of most of our family law clients, and we try not to upset that goal. No one wins when the attorneys encourage unnecessary litigation, or counsel their clients against mediation and settlement.

In a case of divorce with minor children, we encourage the parties to work with the Conciliation Court of Douglas County to develop a "Parenting Plan" which details the issues of custody, visitation, and how to maintain a family from two households. We encourage the parties to try to discuss all aspects of continued mutual parenting, so that the adverse effects of divorce on the children are minimized. We encourage mediation instead of litigation, especially on issues related to children, but we are always prepared to take your case to trial if it is necessary to protect your rights and your children.

· Assets: estimated values on real property, balances on savings, checking, financial accounts;

· Debts: mortgages, credit cards, line of credit and student loans.

· Income: wages, pensions, annuities and other income sources

This will help us get a good picture of your financial situation, so we can better discuss an equitable division of the marital estate. You can provide this information using our Domestic Relations Information Form and bring the form with you to your appointment.
